Acceptance of Terms

By downloading, installing, or using the MagiTale application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

The App is owned and operated by S.C. NORTEC BLANC S.R.L. (“we”, “us”, or “our”), a company registered in Romania with company identification number RO41773828.

Description of Service

MagiTale is a mobile application that helps users create personalized bedtime stories for their children. The App also provides lullabies and calming sounds designed to help children fall asleep.

Upon download, users receive access to two (2) free stories. To create additional stories, users must subscribe to our paid service.

User Accounts

To use certain features of the App, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account.

Subscription and Payment

MagiTale offers a subscription service at $12.99 per month that allows users to create unlimited personalized stories beyond the two free stories provided upon download.

Subscription Terms

• Subscriptions are billed monthly on a recurring basis
• Payment will be charged to your Apple App Store or Google Play account
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage your subscription and turn off auto-renewal by accessing your account settings after purchase
• No refund is provided for the unused portion of any subscription period

User Content

The App allows you to input certain information, such as your child's name, age, and gender, to create personalized stories. You retain all rights to such information, and you grant us a non-exclusive, worldwide, royalty-free license to use this information solely for the purpose of providing the App's services to you.

You agree not to submit any information that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Infringes upon the rights of others
• Contains personally identifiable information of any third party without their consent
• Contains harmful code, such as viruses or other malware

User-Requested Content and Copyright Disclaimer

MagiTale utilizes artificial intelligence to generate personalized stories and imagery based on user inputs and requests. You understand and acknowledge that:

• When you request content that may reference, resemble, or include elements similar to existing copyrighted characters, stories, or other intellectual property owned by third parties, you are solely responsible for such requests
• S.C. NORTEC BLANC S.R.L. is not responsible for any potential copyright or trademark infringement that may occur as a result of user-requested content generation
• Any stories, images, or other content generated by our system based on your specific inputs and requests are produced automatically without human review and solely at your direction
• You agree to indemnify and hold S.C. NORTEC BLANC S.R.L. harmless from any claims, damages, or legal proceedings arising from your request for content that may infringe upon third-party intellectual property rights
• We reserve the right to reject or remove any user-requested content that we believe, in our sole discretion, may violate any copyright or other intellectual property laws

By using our service to generate stories or images based on your inputs, you affirm that you are using such content for personal, non-commercial purposes and within the bounds of applicable fair use or similar legal doctrines.

Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all text, illustrations, graphics, designs, and code) are owned by S.C. NORTEC BLANC S.R.L. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. You may not:

• Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from the App
• Use any illustrations, photographs, video sequences, or any graphics separately from the accompanying text
• Delete or alter any copyright, trademark, or other proprietary rights notices
• Decompile, reverse engineer, or disassemble the App or attempt to derive the source code
• Use the App for any commercial purpose

Limitation of Liability

In no event shall S.C. NORTEC BLANC S.R.L., its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

Disclaimers

The App is provided on an “AS IS” and “AS AVAILABLE” basis. S.C. NORTEC BLANC S.R.L. expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that the App will meet your requirements, be available on an uninterrupted, timely, secure, or error-free basis, or be accurate, reliable, free of viruses or other harmful code, complete, legal, or safe.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us at support@nortecblanc.com or by following the instructions for termination in your account settings. Note that this does not automatically cancel your subscription, which must be done separately.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the App.
