Acceptance of Terms

By downloading, installing, or using the Magitale application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

The App is owned and operated by S.C. NORTEC BLANC S.R.L. ("we", "us", or "our"), a company registered in Romania with company identification number RO41773828.

Description of Service

Magitale is a mobile application that helps users create personalized bedtime stories for their children. The App also provides lullabies and calming sounds designed to help children fall asleep.

Users can access the app for free without needing to provide any payment information. Free users can create up to two (2) custom characters, generate two (2) personalized stories, and listen to two (2) lullaby songs. They also have access to a curated library of stories created by the Magitale team, updated weekly.

Users who subscribe to the Premium Plan gain access to enhanced features, including the ability to create up to 100 characters and generate up to 100 stories per month. Premium users also enjoy full access to the entire lullaby song library and all curated stories.

Third-Party Services & Measurement

The App integrates third-party SDKs and services (including, without limitation, Singular for attribution/analytics and the Meta (Facebook) SDK for advertising performance measurement) to understand installs, subscriptions, and campaign performance. These services may process device information and mobile advertising identifiers solely to provide measurement and analytics. We do not show personalized ads in the App. Use of these services is subject to their terms and privacy policies.

User Accounts

To use certain features of the App, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for any activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account.

Account Deletion

Users may delete their account at any time from within the Magitale mobile app by accessing the Settings - Delete Account section. Alternatively, users may request account deletion by contacting us at support@magitale.com. Deleted accounts will be permanently removed after a retention period of up to 30 days.

Subscription and Payment

Magitale offers a subscription service at $12.99 per month. The Premium Plan includes up to 100 AI-generated characters and up to 100 personalized stories per month, along with full access to all curated stories and lullabies.

• Subscriptions are billed monthly on a recurring basis
• Payment will be charged to your Apple App Store or Google Play account
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage your subscription and turn off auto-renewal by accessing your account settings after purchase
• No refund is provided for the unused portion of any subscription period

Billing, Renewals & Refunds

• Provider Billing. Purchases and subscriptions are billed by Apple App Store or Google Play. We do not store card data and cannot access or modify transactions processed by the stores.
• Auto-Renewal. Subscriptions renew automatically until canceled. Manage or cancel in your store account settings at least 24 hours before the end of the current period to avoid renewal.
• Pricing & Taxes. Prices may change with prior notice where required. Taxes and exchange fees may apply per your store region.
• Refunds. Refunds are handled exclusively by the respective store according to its policies. We do not provide refunds directly.

User-Requested Content and Copyright Disclaimer

• S.C. NORTEC BLANC S.R.L. is not responsible for any user-generated or AI-generated content. If a user requests or creates content that references third-party intellectual property (such as known fictional characters), the responsibility for that content lies solely with the user.
• You agree to indemnify and hold S.C. NORTEC BLANC S.R.L. harmless from any claims or legal issues arising from such content.
• We reserve the right to remove any content that we believe violates intellectual property rights or laws.

License to User & AI-Generated Content

Solely to operate, host, transmit, display, and improve the App, you grant S.C. NORTEC BLANC S.R.L. a worldwide, non-exclusive, royalty-free license to use, reproduce, modify (for formatting), and display content you provide or generate through the App. This license ends when the content is deleted from our systems, subject to reasonable backups and legal retention.

Intellectual Property Rights

The App and its contents are owned by S.C. NORTEC BLANC S.R.L. and protected by international laws. All lullaby songs available in the App are either owned by or licensed to us.

Prohibited Uses

• Reverse engineering or interfering with the App or its APIs.
• Uploading malicious code or attempting to gain unauthorized access.
• Generating or sharing content that is unlawful, infringing, hateful, sexual or violent in relation to minors, or that violates third-party rights.
• Reselling or sublicensing the App or its outputs without permission.

Disclaimers

The App and all content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

Limitation of Liability

To the maximum extent permitted by law, S.C. NORTEC BLANC S.R.L. and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, or goodwill, arising out of or related to your use of the App, even if advised of the possibility of such damages. Our aggregate liability for any claim shall not exceed the amount paid by you to us for the App in the twelve (12) months preceding the event giving rise to the claim, or USD $50 if greater is not permitted.

Termination

We may suspend or terminate access to the App immediately, without prior notice, for any breach of these Terms or to comply with law. Upon termination, your right to use the App ceases; sections that by their nature should survive (including intellectual property, disclaimers, limitations of liability, and governing law) will survive.

Age & Parental Responsibility

The App is intended for use by parents and guardians. You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and will supervise any use of the App by children.

App Store Terms & Third-Party Beneficiaries

When downloaded from the Apple App Store or Google Play, your use of the App is also governed by the applicable store terms. You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you where the App is obtained through the Apple App Store.

End User License Agreement (EULA)

Governing Law

These Terms shall be governed and construed in accordance with the laws of Romania.
